The company behind a proposed Family Dollar store in Ranchos de Taos has filed an appeal in district court, seeking to overturn a decision by the Taos County Commission to deny its application.
The company, 7B Building and Development, a Texas-based construction firm, filed the appeal through an attorney Jan. 28.
The Family Dollar, which would have been the fourth dollar store within a 2.5-mile stretch of Paseo del Pueblo Sur, was OK'd by the county's planning commission Sept. 12. The Ranchos de Taos Neighborhood Association filed an appeal, which the county commission heard Dec. 10. At that meeting, the commission voted unanimously in favor of the neighbors largely because of traffic concerns.
Most dollar stores in Taos County are owned by the same parent company. Dollar Tree bought out Family Dollar in a $8.5 billion merger in 2015. Of the county's five dollar stores, only one is a Dollar General.
Michael Menicucci, the attorney, said 7B will now file a statement of appeal, to which the county will then likely respond.
The case is being handled by 8th District Judge Jeff McElroy.
